These Terms of Service (“Terms”) are between Resonate Tech., Inc. (“Resonate”) and you (“Customer”). The Terms govern your use of Resonate's SaaS services (the “Service”)
Customer may access and use the Service in accordance with the features and functionalities of the plan they have subscribed to (Free, Basic, or Pro), as described on ResonateHQ.com website. Each plan is limited to a specified number of Workflow Action executions. Customer shall not misuse the Service, including but not limited to, attempting to access or use the Service in a manner not authorized by these Terms or AIssistify’s then-current policies.
The Service integrates with HubSpot (requires Customer to have an active subscription to one of the Hubspot hubs: Hubspot Marketing Hub Professional, Hubspot Marketing Hub Enterprise, Hubspot Sales Hub Professional, Hubspot Sales Hub Enterprise, Hubspot Service Hub Professional, Hubspot Service Hub Enterprise, Hubspot Operations Hub Professional ,Hubspot Operations Hub Enterprise), and allows adding a custom action to HubSpot workflows send requests to Resonate services for further processing. Customer acknowledges and agrees that their use of the Service through HubSpot is subject to HubSpot’s terms of service and privacy policy.
The Service is available for purchase on Resonate's website and is subject to the terms and pricing set forth on the website, which are subject to change at Resonate's discretion. Customer’s purchase of the Service constitutes their acceptance of these Terms and any applicable terms and conditions set forth on Resonate's website.
The Service and all intellectual property rights in the Service are and will remain the exclusive property of Resonate. Customer shall not reverse engineer, decompile, disassemble or otherwise attempt to discover the source code or algorithms of the Service.
Customer shall maintain the confidentiality of all information and data related to the Service, and shall not disclose such information to any third party without AIssistify’s prior written consent.
The Service is provided “as is” and Resonate makes no representations or warranties, express or implied, regarding the Service, including without limitation any warranties of merchantability or fitness for a particular purpose.
Resonate shall not be liable to Customer or any third party for any indirect, incidental, special or consequential damages arising out of or in connection with the use of the Service, even if Resonate has been advised of the possibility of such damages.
Resonate may terminate these Terms by providing written notice to Customer. Customer may terminate the Service by sending a request to support@resonatehq.com. After termination notice, the Service will still be provided to Customer until the end of the billing period.
These Terms will be governed by and construed in accordance with the laws of the State of Delaware, United States, without giving effect to any principles of conflicts of law.
These Terms constitute the entire agreement between the parties with respect to the use of the Service and supersedes all prior understandings and agreements, whether written or oral, relating to the subject matter of these Terms.
AIssistify may modify these Terms at any time upon written notice to Customer, and Customer’s continued use of the Service after such notice will constitute their acceptance of the modified Terms.
By subscribing to the Service, Customer acknowledges that they have read and agree to be bound by these Terms.
